Terms of Service

These terms explain what Jaybird Digital provides and where the service stops.

What we provide

Jaybird Digital creates and hosts a website for your organization. The service includes website generation, hosting on Cloudflare, security updates for the managed site, and the AI-assisted design change allowance shown in your plan.

What we do not provide

We do not provide legal, tax, crisis, medical, or professional advice. AI-generated text and designs require your review. The base plan does not include a custom email inbox, design changes beyond the monthly allowance shown in your plan, custom application development, or a custom domain registration fee.

Your content and permissions

You keep ownership of the content, images, logos, and information you provide. You confirm that you have permission to use material you upload or ask us to migrate. You are responsible for reviewing claims, links, contact details, and policies before publishing.

Our access to your account and website

We host your website on our own accounts with our providers, so our staff can open your account and your website's workspace to support you, to investigate a problem, or to keep the service secure and running. Each time a member of staff opens your account as you, we record it and show you the record in your account. We do not change your published website without your approval, apart from routine platform upgrades that keep every website secure and current without touching your content.

Nonprofit verification

Some plans and features require nonprofit verification. We may use public registries, ask for documentation, or provide provisional access while verification is completed. We may suspend nonprofit-only features if verification expires or cannot be confirmed.

Payment, design changes, and cancellation

Subscriptions renew according to the plan shown at checkout. Monthly design changes do not roll over unless the plan specifically says otherwise. Purchased extra design changes expire according to their purchase terms. You may cancel future renewals at any time from your account. If you cancel within 14 days of a plan's first payment, or within 14 days of the payment that starts an annual year (an annual renewal, or a switch from monthly to annual), you may choose a full refund of those payments; your custom domain then displays a paused page right away. Otherwise no refund is issued, and monthly and annual plans keep your custom-domain website online through the end of the paid period. If you switch a monthly plan to annual within 30 days of its first payment, everything you paid for the plan is credited toward the first year. Failed renewals have a seven-day payment grace period. After that period, or when a cancelled paid period ends, your custom domain displays a paused page and your original website remains available at a free domainless address. Paid editing and other paid services are unavailable without an eligible plan. Only a platform administrator can permanently delete a website.

Taking your website code with you

You can request a ZIP of your website source and public media, and optionally an independent private GitHub copy sent to your personal GitHub account. We do not transfer or grant access to the managed repository. Code export costs a one-time $50 before you have completed seven months of elapsed paid-plan coverage. It is free after seven months for monthly and annual customers. Annual prepayment does not qualify immediately; unpaid gaps do not count. After paying the export fee, fresh source copies for that website have no additional export fee. Code export does not cancel a plan or transfer a domain. Product catalog and shop presentation settings are included as JSON when a catalog exists. Managed services need reconnection; private orders, customer accounts and payment records require a separate data migration when you host elsewhere.

Website availability

We work to keep managed websites available, but no online service is uninterrupted. We may pause a site or request when it violates law, infringes another person's rights, abuses the service, or creates a security risk.
